Patna High Court CR. MISC. No.25355 of 2022(2) dt.25-08-2022 2/3 grant of regular bail in a case registered under sections 25(1-B) (a), 26 and 35 of the Arms Act.

As per the prosecution case, it is alleged that the petitioners and the co-accused persons looted a truck loaded with milk power on gun point. Later on they were apprehended by the police. On search, a looted truck loaded with milk powder, mobile phone, arms and ammunition were recovered. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the possession of the petitioners. The other co-accused person has already been granted bail vide order dated 09.05.2022 passed in Criminal Misc No. 9755 of 2022 by the Co-ordinate Bench. The petitioners are accused in one more criminal case as stated in para 3 of the bail petition. The petitioners are in custody since 24.10.2021.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount

Patna High Court CR. MISC. No.25355 of 2022(2) dt.25-08-2022 3/3 each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram (M) P.S. Case No. 382 of 2021.
