====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-05-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 379, 341, 323, 504, 506, 427/34 of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of the occurrence, while the informant was at his shop, these petitioners came there and abused and assaulted the informant by means of lathi and snatched away his golden chain.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.28051 of 2024(2) dt.14-05-2024 2/2 allegation against the petitioners is general and omnibus. As a matter of fact, few days prior to the occurrence, father of the informant was making video of the family members of petitioner Nos. 2 and 3 which was objected by the petitioners and on the day of the occurrence, petitioners went to the shop of the informant and requested him to delete the video and when the informant refused to do so, scuffle took place between the parties. Rest of the allegations are ornamental in nature only to make the case grave. Petitioners claim clean antecedent.

Considering the nature of allegation, backdrop of the case and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Karakat P. S. Case No. 36 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
