JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 04-02-2016 Petitioners apprehend their arrest in a case under sections 20 and 22 of the NDPS Act.

The informant, SI of Mansi Police Station recovered 165 kilograms Ganja from a Tata Indigo Car bearing registration no. WB-74AF-7131. He stated that on information from shop keepers, villagers and spy, he learnt that the petitioners and other four accused persons had brought said psychotropic substance.

Petitioners submit that the contraband Ganja was neither recovered from their possession nor they are owner of the vehicle, rather on search police got papers from the vehicle showing one Shyam Verman as its owner. They further submit that they have no antecedent and even no witness has stated about their involvement.

In the facts of the case, in case of surrender, let both

No.51774 of 2015 (3) dt.04-02-2016 2/2 the petitioners, named above, be released on bail on furnishing bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge -I, Khagaria in Special case no. 07 of 2015, Mansi Police station Case No. 194 of 2015.

The petitioners would not physically absent for two consecutive dates at a stretch, till one witness is examined in the trial.
