JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Section 379 of the Indian Penal Code.

Learned counsel submits that the motorcycle was recovered from the premises of one Mritunjay Pandey and Ranjeet Kumar. The name of the petitioner figured in the confessional statement, as amongst the persons, who used to sell the stolen motorcycles. Learned counsel submits that the petitioner does not have any criminal antecedent and the motorcycle has not been recovered from his possession.

Having regard to the aforesaid facts, in the event of arrest or surrender before the court below within four weeks from today the above named petitioner be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the

Patna High Court Cr. Misc. No.52109 of 2015 (3) dt.04-02-2016 2 / 2 like amount each to the satisfaction of Chief Judicial Magistrate, Arrah in connection with Arrah Town P.S. Case no. 409 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C. with the condition that the petitioner will visit to the nearby police station once every two months and would file an affidavit to the aforesaid effect before the court below.
