In this case, the petitioner has applied for the post of constable under the Extremely Backward Class Category (Female), but could not be selected.
In the petition, the ground has been shown that her name is 'Asha Kumar' but wrongly her name is printed in the Admit Card as 'Isha Kumari'. The petitioner was not given her
Patna High Court CWJC No.13425 of 2013 dt.27-10-2016 2/2 appointment letter though she has filed several representations for publication of the result.
In the counter affidavit, the Central Selection Board has fairly stated that admittedly, there was a mistake in the name of the petitioner, but, in paragraph No.14, it has been stated that the petitioner has secured 135 marks and the cut off marks in her category is 135 marks. She has secured equal marks vis-à-vis the last candidate who has been appointed, but she could not be appointed on the ground that the last person who has secured equal marks was older than the petitioner as the date of birth of the petitioner is 10.02.1993 and the last person who has been selected in her category having date of birth 3.3.1990. Learned counsel for the petitioner is not in a position to contradict the aforesaid statement made in the counter affidavit. In such view of the matter, this Court does not find any merit in the present writ application. Accordingly, this writ application is dismissed.
