JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2020 Heard learned counsel for the petitioner as well as learned counsel for the State through video conferencing. The petitioner seeks bail in Barbigha Police Station Case No. 175 of 2019/POCSO Case No.34 of 2019 registered for the offences punishable under sections 363, 366A/34 of the Indian Penal Code and sections 4/6 of the POCSO Act. Report of the trial court (Additional Sessions Judge I, Sheikhpura) dated 14.10.2020, received in light of order of this Court dated 6.10.2020, discloses that the case is fixed for evidence and out of five charge sheet witnesses, one witness has been examined so far and the next date for evidence is 24.10.2020.

In view of the report of the trial court, the bail petition of the petitioner is refused with direction to the trial court to
