The petitioner apprehends his arrest in a case registered for the offence under Section 406 of the Indian Penal Code.

As per the prosecution case, this petitioner obtained a signature of the complainant at the time of giving loan to him for treatment and it is alleged that he converted the signature of the complainant as an agreement for due payment of Rs. 7,00,000/-, otherwise, he will execute a sale deed of land of his share.

It is submitted on behalf of petitioner that complainant has filed present complaint only with a view to grab the loan

Patna High Court CR. MISC. No.27035 of 2023(2) dt.07-07-2023 2/2 amount, which he had taken from petitioner, and to save his skin from the complaint case i.e. C.A. Case No. 1902 of 2022 (Annexure 2), which has been filed by the petitioner against the complainant on 19.09.2022, in which, cognizance has already been taken against complainant. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Complaint Case No. 1832-C of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
