The petitioners apprehend their arrest in connection with Phenhara P.S. Case No. 21 of 2016, registered for the offences punishable under Sections 447, 147, 148, 149, 323, 324, 504, 506, 379 and 307 of the Indian Penal Code. In the F.I.R. there is no allegation against the petitioners for assaulting the informant. The petitioners have been implicated in this case in retaliation of Phenhara P.S. Case No. 19 of 2016 lodged by Mahadeo Pandit, the uncle of the petitioners, that case is of earlier and, as such, the petitioners deserve sympathetic consideration.

No.22804 of 2017 (3) dt.07-07-2017 2/2 The learned A.P.P. fairly submits that specific allegation of assault is against Bian Pndit and Mahadeo Pandit In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XII, Motihari, East Champaran, in connection with Phenhara P.S. Case No. 21 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
