The petitioner seeks bail in Nalanda P.S. Case No. 184 of 2018, instituted for the offence under Section(s) 302/34 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report.
It is alleged in the written report that informant learnt in the village that one dead body of a boy is lying near Masahi. The informant went there and found the dead body of his son. Learned Sessions Judge has mentioned in the impugned order that during investigation on the basis of CDR it appears that son of the informant (since deceased) had talked with July Kumari, who is sister of Rajmani Kumar @ Ragini
Patna High Court CR. MISC. No.23470 of 2019(2) dt.11-04-2019 2/2 on his Mobile. Rajmani Kumar has admitted this fact in his statement recorded in paragraph-40 of the case diary. In paragraph-45 of the case diary the witness Raju has stated that son of the informant was having love affairs with Juli Kumari. During investigation all the witnesses have stated that on account of love affairs, the father of the girl namely, Juli Kumari along with petitioner and other accused persons have committed murder of son of the informant.
Petitioner is in custody since 30.12.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Nalanda P.S. Case No. 184 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
