The petitioners, namely, Shyam Lal Ram and Subodh Prasad Sinha @ Subodh Kumar Singh, apprehend their arrest in Terhagachh P.S. Case No. 27/2016 registered under Sections 147, 149, 341, 342, 323, 189, 353 of the Indian Penal Code. The informant alleged that a procession comprising about 50-60 motorcyclists was taken out for canvassing on behalf of the petitioner no. 1 Shyam Lal Ram, who was a candidate of the Zila Parishad. The petitioner no. 2 Subodh Prasad Sinha @ Subodh Kumar Singh is the agent of the petitioner no. 1. It is submitted that no specific allegation is made against the petitioners.
Considering the nature of allegation made against the
Patna High Court Cr.Misc. No.28035 of 2016 (2) dt.02-09-2016 2/2 petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Terhagachh in the district of Kishanganj in Terhagachh P.S. Case No. 27/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
