13-02-2018 Heard Sri Manish Rai Sharma, learned counsel for the petitioners and Sri Amit Kumar Rakesh, learned Addl. Public Prosecutor.

Two petitioners, apprehending their arrest in Rajpur P.S. Case No. 186 of 2017 registered for offence under Sections 147, 341, 323, 324, 307, 504 of the Indian Penal Code, have prayer for grant of bail in the event of their arrest or surrender. By way of referring to F.I.R., learned counsel for the petitioners submits that though, there was no such material for application of Section 307 of the Indian Penal Code, but besides other sections, Section 307 of the Indian Penal Code has also been added in the F.I.R.

Besides hearing, I have also perused the material on

Patna High Court Cr.Misc. No.7388 of 2018(2) dt.13-02-2018 2/2 record, particularly F.I.R. and after going through the same, I am of the opinion that it is a fit case for extending the privilege of anticipatory bail.

Accordingly, in the event of arrest or surrender within a period of six weeks from today, let both aforesaid petitioners namely Baban Rai and Mritunjay Rai @ Mritunjay Kumar @ Pappu be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - VII, Buxar in connection with Rajpur P.S. Case No. 186 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J.) anay U T
