The petitioner apprehends his arrest in a case under Sections 33(1)(b) and 41/42 of the Indian Forest (Bihar Amendment) Act, 1989.
It is submitted that a raid was conducted on 20.11.2013 and some stone chips, boulders, etc. were found within the area of Kauwakhoh forest. It is further submitted that the raid was conducted on 20.11.2013 but the complaint was filed on 25.03.2014. The petitioner was not apprehended on the spot. The petitioner is a licensee, duly granted a licence thereof by the Mines and Minerals Department.
Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on
Patna High Court Cr.Misc. No.51756 of 2015 (2) dt.21-12-2015 2/2 bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Forest Case No. 190/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
