ANJANA MISHRA ORAL ORDER 21-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner being the Branch Manager of Central Cooperative Bank is apprehending his arrest in connection with Complaint Case No. 2611 of 2010 Tr. No. 5097 of 2014, registered for offences punishable under Section 406 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present case has been lodged against him by way of a vendetta on the point that the petitioner declined to give the informant subsidy for a pump set as the informant was already having a pump set in his name. It is further submitted that the allegation as made out that the informant has given Rs. 2,00,000/- and deposited the same in his own account by way of paying slip, but the same was not

Patna High Court Cr.Misc. No.52330 of 2015 (2) dt.21-01-2016 2/2 deposited appears to be misconceived in view of the fact that the informant is not having any receipt and that only false allegation has been made that the petitioner had in fact, loss the said receipt. Considering the nature of allegation and that there has been some apparent dispute between the petitioner and informant with regard to grant of loan and subsidy from the bank, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri M.K. Srivastava, Judicial Magistrate, Siwan in connection with Complaint Case No. 2611 of 2010 Tr. No. 5097 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J) sunil/- U T
