JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-08-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Ganga Bridge P.S. Case No. 71 of 2015 registered under Sections 420, 406 of the I.P.C. read with 138 of the N.I. Act pending in the Court of C.J.M., Vaishali at Hajipur. The accusation is that the petitioner took loan of Rs. 7 lacs to run the brick kiln from the informant Ranjeet Singh. On demand, he gave Cheque No. 56816 of IDBI Bank, Hajipur in favour of informant but the said cheque was dishonoured due to non-availability of the money.

Learned counsel appearing on behalf of the petitioner submits that in fact, the petitioner has filed the Complaint Case

Patna High Court Cr.Misc. No.33307 of 2016 (2) dt.26-08-2016 2/2 No. 3291 of 2015 against the informant under Sections 406, 420, 323, 307, 468, 384 and 387/34 of the I.P.C. on 14.09.2015. On the other hand, learned counsel for the informant submits that after lodging the present case with ulterior motive, the Complaint Case has been filed by the petitioner. Having considered the facts and circumstances of the case, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer for the petitioner is rejected.
