JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This is an application for grant of anticipatory bail in connection with Chandi P.S. Case No.338 of 2018 disclosing offence under Section 302/34 of the Indian Penal Code. Allegation as per F.I.R. against the petitioners is that while the petitioners and other persons were damaged the paddy crops, on protest by the mother of the informant, they assaulted on her nose causing injury and thereafter she fell down and ultimately she died.

Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against the petitioners and the postmortem shows that the cause of death is hemorrhage and shock.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Class, Hilsa, District Nalanda, in connection with Chandi P.S. Case No.338 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
