Let the defect(s) be removed within four weeks of the complete start of the physical Court in normal course. The petitioner is in judicial custody in connection with Dariyapur P.S. Case No.431 of 2021 instituted under Section 392 of the IPC.

As per the allegation in the FIR, the informant, the Manager of the Aditya Petrol Pump, Ibrahimpur, Dariyapur alleged that when he along with another employee were going to deposit Rs.6,34,000/- in the Central Bank of India, the accused persons on a motorcycle overtook them and on the point of pistol and knife snatched the aforesaid amount as also the laptop. Later they fled away from the place of occurrence. Learned counsel for the petitioner submits that he is

No.25216 of 2022(2) dt.10-08-2022 2/3 innocent and his name has come in the confessional statement of accused Ritu Kumar, however subsequently he has been arrested but nothing has been recovered from his personal possession. He further submits that despite his arrest, the police failed to conduct any T.I. Parade and he is in custody since 16.01.2022 (as stated in para-1 of the bail application). Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each in connection with Dariyapur P.S. Case No.431 of 2021 to the satisfaction of learned ACJM,XIII, Saran at Chapra, subject to following conditions: (i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reasons will entail cancellation of his bail by the Trial court itself;

(iii) the petitioner shall appear before the concerned police station every month for next six months to mark his presence;

(iv) the petitioner shall desist from committing any

With the aforesaid observations, the bail application is allowed.
