JUSTICE RAKESH KUMAR ORAL ORDER 22-05-2015 Heard learned counsel for the petitioners, learned AC to AAG No. 6 as well as Sri Shailendra Kumar Jha, learned counsel, who has appeared on behalf of the private respondents. The present writ petition pertains to a dispute under the provisions of Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956, which is a Scheduled Act under the provisions of Bihar Land Tribunal Act, 2009. The Bihar Land Tribunal constituted under the provisions of the Bihar Land Tribunal Act, 2009 is already functioning. Accordingly, the court considers that this matter can well be adjudicated by the Bihar Land Tribunal.

In view of proviso to Section 15 of the Bihar Land Tribunal Act, 2009, the Registry is directed to transmit the record of this case to the Bihar Land Tribunal forthwith. (Rakesh Kumar, J) Praful/- U
