ANJANA MISHRA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 10.07.2018 in connection with Laxamipur P.S. Case No.302 of 2017 (G.R. No.2938/2017) registered for the offence under Sections 395, 397, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. nor has any recovery been made from his possession. It is further submitted that the petitioner's name transpired during the investigation on the basis of the confessional statement made before the police by co-accused Mohan Manjhi and till date he has not been placed on T.I. Parade. Learned counsel for the petitioner has submitted that save and except the

Patna High Court CR. MISC. No.24921 of 2019(2) dt.18-04-2019 2/3 confessional statement, there is no further positive material against the petitioner. Learned counsel for the petitioner submits that so far as his criminal antecedent is concerned, after his arrest in connection with the present case, he has been implicated in various other cases and remanded in connection with the same. He thus submits that the petitioner may be extended the privilege of bail and he will co-operate in the trial and not participate in any further offence.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri S.K. Singh, J.M. 1st Class, Jamui, in connection with Laxamipur P.S. Case No.302 of 2017 (G.R. No.2938/2017), subject to the following conditions :

(1) One of the bailors will be his blood relative, preferably, father, mother, brother, sister and/or his wife.

(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioner shall remain physically present in court on each and every date during trial and in

(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (Anjana Mishra, J) PNM U T
