The petitioner apprehends his arrest in Alamganj P.S. Case No. 72/2016, registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code. The father of the victim made allegation that the petitioner kidnapped his minor daughter while she was coming after examination.

Learned counsel for the petitioner submits that the victim was in love with the petitioner and she voluntarily went along with the petitioner to New Delhi, but from perusal of the statement of the victim it appears that the victim made allegation that Gaurav Diwaker and Abhishek Kumar kidnapped her on motor-cycle and thereafter the petitioner Golu @ Mritunjay

Patna High Court Cr.Misc. No.29233 of 2016 (4) dt.26-10-2016 2/2 Kumar took her to Delhi on train. The victim is a minor girl and there is specific allegation that the petitioner on threat took her to Delhi.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
