All the petitioners who are named in the FIR registered under Section 447, 341, 323, 324, 325, 307, 379, 504 and 506/34 of the IPC, have approached this Court for grant of anticipatory bail.
Owing to land dispute the scuffle had taken place wherein specific allegation of assault to some of the witnesses have been attributed against the petitioner nos. 1, 4 and 5. Learned counsel submits that there is a counter version of
Patna High Court Cr.Misc. No.2591 of 2018(2) dt.15-01-2018 2/2 the incident wherein some of the petitioners also received injury (Annexure 2).
Considering the submissions made at Bar and after taking into account the fact that there is no specific allegation attributed to petitioner nos. 2,3, 6 , 7 , 8 and 9 viz. Mantazir, Nazim, Bibi Arshadi @ Arshadi, Bibi Shamina @ Shamina, Bibi Lali @ Lali and Bibi Chandani @ Chandani respectively they, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Araria in connection with Jokihat Police Station case no. 353 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that one of the bailors in each case shall be the own/close family members.
The prayer for bail made on behalf of the petitioner nos. 1, 4 and 5 viz. Azimuddin @ Azim, Mantasir @ Mantashir and Tazzuddin @ Tajuddin respectively is rejected. (Kishore Kumar Mandal, J) shyambihari/- U T
