Mr. K.K. Jha (AAG-14) =========================================================== CORAM: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI and HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL JUDGMENT (Per: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI) Date: 08-05-2017 Heard counsel for the appellant and the counsel for the State.
On 08.04.2017, the Court gave an opportunity to the appellant to produce the educational certificates, which formed the basis for begetting employment under the State, because the Court wanted to go to the root of the matter, as the allegation against the appointment was that he had obtained employment under some kind of forged or begotten kind of certificates.
When the Learned Single Judge tried to help the situation by giving indulgence to the appellant as well as benefit of doubt by
Patna High Court LPA No.1072 of 2014 dt.08-05-2017 2/2 giving opportunity to produce the original certificates, the issue was diverted and avoided. Here also in appeal, now, a plea is taken that everything is lost. If that is so, then the appellant has rightly lost the case before the Learned Single Judge because appellant does not want to come clean even before the temple of justice. No interference is warranted with the order of the Learned Single Judge.
Appeal is dismissed.
