The appellant seeks pre arrest bail in connection with Patahi P.S.Case No.17 of 2017, registered for offences punishable under Sections 406,409, 420, 467, 468, 471, 504 & 120B/34of the Indian Penal Code and section 3(i)(x) of SC/ST (Prevention of Atrocities) Act.
Allegation against the appellant and other accused persons is that when the informant raised grievance against defalcation of government money, they abused the informant by taking caste name.
Submission of the learned counsel for the appellant is that nothing specific has been attributed against the appellant and
Patna High Court CR. APP (SJ) No.2336 of 2017 (3) dt.31-08-2017 2/2 there is general and omnibus allegation. One of the co-accused persons has been granted privilege of anticipatory bail by this Court vide order dated 01.08.2017 passed in Cr. Appeal (S.J.)No.2203 of 2017.
Heard learned Special P.P. and the learned counsel for the informant.
Having considered both sides and in view of facts and circumstances as stated above, let the appellant surrender and make prayer for regular bail before the court of learned Special Judge, who will consider all aspects of the matter that no specific allegation has been attributed against the appellant and further another co-accused has been granted privilege of anticipatory bail. Considering all aspects of the matter, the learned Special Judge will pass appropriate order without being prejudiced by the order of this Court, if possible on the same day. With the above observation, this appeal is disposed of.
