====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.
The petitioner seeks bail in connection with Belhar P. S. Case No.328 of 2019, instituted for the offences under Section 392 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 20.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.
The learned counsel for the petitioner further submits that the informant in the F.I.R. alleges that on 25.10.2019 when he along with one Parwat Kumar Singh were working at Om Sai Petrol Pump, Gorgawan, three

No.33943 of 2021(2) dt.01-12-2021 2/3 miscreants came on Scorpio vehicle and looted a mobile from the possession of the informant and Rs.4,000/- and a mobile phone from possession of Parwat Kumar Singh. Learned counsel for the petitioner submits that F.I.R. was against unknown. The name of this petitioner has come in the confessional statement of Uttam Kumar and the said Uttam Kumar @ Uttam Ram has been granted bail by order dated 13.04.2021 in Cr. Misc. No.4781 of 2021. Learned A.P.P. opposes the bail application.
Considering the fact that the co-accused in whose confessional statement the name of this petitioner has been surfaced has been granted bail. Petitioner being a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Belhar P. S. Case No.328 of 2019, subject to condition that when the trial commences and if petitioner does not appear before the Court below on two consecutive dates, the learned Court below shall be at
Patna High Court CR. MISC. No.33943 of 2021(2) dt.01-12-2021 3/3 liberty to cancel his bail bonds.
