Heard Mr. Bela Sah, learned counsel for the petitioner, and Mr. N.K.Pandey, learned Additional Public Prosecutor, appearing for the State.

Having considered the averments made in the application and having heard the learned counsel for the petitioner, I am satisfied that the absence of the petitioner and/or his counsel from the Court on 29.06.2016 was for reasons beyond their control. In view of the above and in the interest of justice, the restoration application is allowed and Cr.W.J.C. No. 437 of 2016 aforementioned is hereby restored to its original file. This Misc.
