This writ application has been filed seeking quashing of letter no. 22/6 dated 20.05.2022 issued under signature of Senior Branch Manager (Respondent No. 8). By the impugned communication, the Bank has communicated that because of a
Patna High Court CWJC No.6383 of 2023(2) dt.22-06-2023 2/3 dispute raised against the letter of the Principal of the College and the resolution with regard to operation of the account, the competent authority of the Bank decided to withhold the operation of the account and called upon the President of the Managing Committee of Ramakant Rajeshwari Inter College, Lakhanpur, (Khoksa), Vaishali to bring a Court order. It is not in dispute that this very petitioner had raised the dispute with the Bank and because of his complaint the communication as contained in Annexure '10' to the writ application was issued by the Bank.
Learned counsel for the petitioner submits that at this stage, he has no objection to the operation of the bank account of the College.
Learned counsel for the Bihar School Examination Board as well as the Bank are present. The Bank is not in adversarial litigation in the present case. It is thus submitted that if the petitioner makes a representation with an affidavit withdrawing his complaint and an authenticated copy of the resolution with regard to operation of the Bank account is received from the Principal of the College, the Bank would definitely consider the same and will take an appropriate decision within the shortest possible time.
Patna High Court CWJC No.6383 of 2023(2) dt.22-06-2023 3/3 In view of the aforesaid stand of the Bank, this Court grants liberty to the petitioner to file a representation before the Respondent No. 8 with an affidavit, letter from the Principal of the College and authenticated copy of the resolution within a period of 30 days from today which will be considered by the Respondent No. 8 and an appropriate decision thereon shall be taken within 30 days from the date of receipt of the representation.
