====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Rajgir P.S. Case No. 419 of 2021 lodged under Section 392 of Indian Penal Code.

It has been mentioned by the petitioner that the present case has been lodged under Section 392 of Indian Penal Code against three unknown persons, the name of the petitioner has been figured on the statement of one of the accused of this case namely Md. Parwej Alam.

Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner, no T.I.P. has been taken place in this case till date. On the point of criminal antecedent it has been submitted by the

Patna High Court CR. MISC. No.26446 of 2022(2) dt.06-07-2022 2/2 counsel for the petitioner that there is one case of different nature is pending against him in which he is on bail. It has also been submitted that petitioner is in custody since 14.11.2021 and charge sheet has already been filed.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case that name of petitioner has figured on the basis of confessional statement of co-accused and no T.I.P. takes place nor anything alleged to have been recovered from his possession, petitioner is in custody since 14.11.2021 and charge sheet has already been filed in this case, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/Successor court Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 419 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
