The petitioner seeks bail in anticipation of her arrest in connection with Rosera P.S. Case No. 196 of 2017 dated 10.08.2017 instituted for the offences under Sections 120(B), 201 and 302/34 of the Indian Penal Code.

The mother of the deceased has lodged the F.I.R. alleging that her daughter (deceased) had run away with her elder brother-in-law to Delhi. Later, the deceased came back home. For her insistence for living in adulterous relationship with her brother-in-law, the mother (informant) had severed all her ties with her. Later the informant learnt that the deceased has died. No.25406 of 2018(2) dt.03-05-2018 2/3 law with whom the deceased had been residing along with other members of the family including the petitioner who is younger sister-in-law of the deceased. Learned counsel for the petitioner has submitted that in the entire body of F.I.R., nothing has been alleged against the petitioner except for a bald suspicion that the petitioner also has conspired with the other family members in killing the deceased. Under similar circumstances, the wife of the elder brother of the husband of the deceased has been granted regular bail by a bench of this Court on 17.02.2018 in Cr. Misc. No. 59141 of 2017.

Since there is no accusation against the petitioner and she is the younger sister-in-law of the deceased, this court is inclined to grant anticipatory bail to her.

The petitioner above named is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Rosera, Samastipur in connection with Rosera P.S. Case No. 196 of 2017,
