ANJANA MISHRA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 20.02.2019 in connection with Wazirganj P.S. Case No.50 of 2019 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Sections 25(1-b)A and 26 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that though it is alleged that the liquor and the arms were recovered, the same were not recovered from the conscious possession of the petitioner. It is further submitted that the petitioner has no criminal antecedents and has been falsely implicated in connection with the present case.

Considering the aforementioned facts and

No.24877 of 2019(2) dt.17-04-2019 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya, in connection with Wazirganj P.S. Case No.50 of 2019.
