The petitioner seeks bail in anticipation of his arrest in connection with Janta Bazar P.S. Case No. 162 of 2017 dated 17.10.2017 instituted for the offences under Sections 30(a)/41 of the Bihar Prohibition & Excise Act, 2016 and Sections 272, 273 and 308 of the Indian Penal Code.

2600 litres of liquor is said to have been recovered from a vehicle from where two persons were spotted running away. The petitioner has been identified as one of such persons by the local Chowkidar.

Learned counsel for the petitioner has submitted that the accusation is absolutely false. The petitioner has got no concern with either the vehicle or the liquor which has been

Patna High Court CR. MISC. No.35136 of 2021(2) dt.26-04-2022 2/2 seized from such vehicle. He is a daily-wage earner and has been made accused in this case only on suspicion. The petitioner does not have criminal antecedents. On these grounds it has been urged on behalf of the petitioner that the offence under the Excise Act cannot at all be said to have been made out against him.

For the reasons aforestated, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge; Excise Act; Saran at Chapra in connection with Janta Bazar P.S. Case No. 162 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
