JUSTICE JYOTI SARAN ORAL ORDER 15-12-2015 Heard Mr. Ravi Ranjan, learned counsel for the petitioner and learned counsel for the State. The petitioner apprehends her arrest in connection with Pawana P.S. Case No. 22 of 2015 for the offences punishable under Sections 420, 409, 467, 468 and 471 of the Indian Penal Code.
Allegation against the petitioner is of obtaining a teacher's appointment on the basis of forged documents. Mr. Ravi Ranjan, learned counsel for the petitioner submits that the very basis for the allegation does not survive since the certificate was put to enquiry and which has been upheld by the authorities. He produces a letter of the District Programme Officer addressed to the Director, Navbharat
Patna High Court Cr.Misc. No.52942 of 2015 (2) dt.15-12-2015 Shiksha Parishad to report on the genuineness of the certificate and which has been responded to by the Administrative Officer on 11.4.2015 upholding the validity thereof.
Let the letter so relied upon by Mr. Ranjan be maintained on the record of the proceedings.
Having heard learned counsel for the parties and the circumstances discussed, let the petitioner, namely, Vandana Kumari in the event of her arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class-Ara, Bhojpur and/or the court concerned in connection with Pawana P.S. Case No. 22 of 2015, G.R. No. 2436 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
