====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-08-2020 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Saharsa Sadar P.S. Case No. 56 of 2020 for the offence under Section 414 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act.

Allegation against the petitioner is that 11 cartridges of 8 MM KF and one 9MM live cartridge as well as other articles were seized from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 29.01.2020.

Considering the fact that the petitioner has got no criminal antecedent and he has remained in custody for about seven months, the petitioner named above, is directed to be

No.22545 of 2020(2) dt.28-08-2020 2/2 released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 56 of 2020 with the condition that the petitioner on release will render his service as volunteer for a period of one month in dedicated Covid Hospital. He is required to report to the District Nodal Officer in the concerned region, who shall utilize his service in this pandemic.
