JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 The petitioner is apprehending his arrest in connection with Chausa P.S. Case No. 280 of 2017, registered for offences punishable under Sections 366, 323, 506 and 34 of the IPC. Allegation against the petitioner is of kidnapping daughter of informant.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case by the informant due to previous enmity as he is the neighbour of the informant. It has also been submitted that there is delay of six days in lodging the F.I.R and no explanation has been given for the same. Further petitioner has no criminal antecedent.
Learned counsel for the State has opposed the prayer for bail on the ground that the girl in her statement under Section 164
Patna High Court Cr.Misc. No.3734 of 2018 (2) dt.01-02-2018 2/2 Cr.P.C. has named this petitioner.
Having heard both sides, considering the facts and circumstances of the case and nature of allegation, I am not inclined to grant the privilege of anticipatory bail to the petitioner. this application is, accordingly, dismissed.
However, petitioner if so desire may surrender before the court below and pray for regular bail and if any such application is filed the court below shall dispose of the same on the merit of the case.
