ANJANA MISHRA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 13.02.2019 in connection with Belaganj P.S. Case No.292 of 2018 registered for the offence under Sections 420 and 34 of the Indian Penal Code, Sections 63 and 65 of the Copyright Act, 1954 and Sections 103 and 104 of the Trademark Act, 1999. Learned counsel for the petitioner submits that some sort of raid was conducted but finding the petitioner not present, he was implicated in connection with the recovery of fictitious pouches of Dabur Oil and therefore, he is facing prosecution. It is further submitted that one Parvej Rajak was also arrested from the place of occurrence whereas the petitioner was found

Patna High Court CR. MISC. No.24915 of 2019(2) dt.18-04-2019 2/2 to be absent. Learned counsel for the petitioner submits that the said Parvej Rajak has been extended the privilege of bail in B.P. No.506 of 2016 vide order dated 24.11.2018.

Having considered the aforementioned facts and circumstances and also the fact that the petitioner has no criminal antecedents and similarly situated co-accused has since been extended the privilege of bail, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XI, Gaya in connection with Belaganj P.S. Case No.292 of 2018.
