ANJANA MISHRA ORAL ORDER 18-10-2016 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Hajipur Town P.S. Case No. 378 of 2016 registered for the offences punishable under Sections 326 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that though there is an allegation that the informant was attacked while he was coming back from Diara, the allegation is specific as against one Jagnarayan Ray for having ordered to fire whereupon one Shivshankar Ray @ Shivu fired. The cause of the occurrence is said to be land dispute between the parties. So far as the present
Patna High Court Cr.Misc. No.32928 of 2016 (2) dt.18-10-2016 2/2 petitioner is concerned, it is alleged that he was also present there and had surrounded the informant.
Considering the facts that there was no repetition of blows and no intervening circumstance to prevent the occurrence and that the petitioner has no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 378 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J.) ravi/- U T
