The petitioner seeks anticipatory bail in connection with Panapur P. S. Case No. 46 of 2016, registered for offences punishable under Sections 366 (A)/34 of the Indian Penal Code. The allegation against the petitioner and other accused persons of kidnapping of minor girl of the informant. Submission of the learned counsel for the petitioner is that the petitioner is not named in the F.I.R. and no specific allegation has been levelled against the petitioner and other accused persons have been granted bail by the learned Court below. It is also submitted that the name of the petitioner has surfaced on the confessional statement of victim, which was recorded under Section 164 of the Cr. P. C. and victim left her house with her own sweet will.

Patna High Court Cr.Misc. No.20147 of 2018(2) dt.12-04-2018 2/2 Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above application is disposed of with a direction to the petitioner that if the petitioner surrenders in the court below within four weeks and makes prayer for regular bail, the same shall be considered on the basis of material available against the petitioner without being prejudiced by this order.
