In this case, the petitioner is apprehending his arrest in connection with Hathua P.S. Case No. 17 of 2014 registered for offences under sections 363, 364 and 201 of the Indian Penal Code.

An allegation has been made that the son of the Informant and the present petitioner, with an intent to get an offshore service, after obtaining the passport, had gone to Mumbai for medical check up but, he did not returned from there. Further allegation has been made that the Informant received call from the present petitioner to give Rs. 5,000/- as the son of the Informant has fallen sick and is carrying him to admit in the hospital. The

Patna High Court Cr.Misc. No.6059 of 2018 (2) dt.02-02-2018 Informant went to the said hospital but she did not find her son there. She returned back to her house and went to the house of the petitioner, on enquiry, he gave evasive reply which led to lodging of the present case but, Annexure-2 is the compromise application filed by the Informant herself wherein she has stated that her son had gone to Mumbai for job and he used to talk with his friend in the facebook which she has seen from her own eyes and her son is alive.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, Subash Kumar Manjhi @ Subash Manjhi, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Hathua P.S. Case No. 17 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
