The petitioner apprehends his arrest in connection with Mairwa P.S. Case No. 65 of 2015 registered under Sections 147, 148, 149, 341, 323, 307, 302 and 429 of the Indian Penal Code pending in the court of Chief Judicial Magistrate, Siwan. The allegation is that six persons named in the F.I.R. including the petitioner reached on motorcycle at the door of informant, Rangbahadur Singh and caught hold Jitendra Singh and assaulted with fist and slaps. Thereafter, they also shot fire at Jitendra Singh, who died later on.
Learned counsel for the petitioner submits that, in fact, at the time of occurrence, the petitioner was present at Patna
Patna High Court Cr.Misc. No.54961 of 2015 (4) dt.11-12-2015 but he has falsely been implicated in this case due to dirty village politics.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
