The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323, 341, 307, 504 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 02.08.2021, while he was having breakfast in his verandah, his neighbor (petitioner no.1) started abusing him and when his elder and younger sister-in-law protested then they were also abused and assaulted with fist and kick, it is further

Patna High Court CR. MISC. No.25476 of 2022(2) dt.14-11-2022 2/3 alleged that the accused persons, including the petitioner no.2, dashed the brother of the informant on ground and sat on his chest and when informant intervened, all the accused persons assaulted him.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case, it is next submitted that on account of dispute relating to land, the present occurrence is alleged to have taken place, it is also submitted that the injuries suffered by the injured are simple in nature which amply demonstrates that the petitioners never had any intention of committing a serious occurrence and admittedly the petitioners are persons with clean antecedent. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Basopatti
