No-one appears on behalf of the State.

The petitioner apprehends his arrest in connection with Paliganj P.S. Case No. 134 of 2013 registered for the offences punishable under Sections 147, 341, 323, 504, 326 and 307 of the Indian Penal Code.

Learned counsel for the petitioner submits that although the petitioner is named in F.I.R., but there is no specific allegation against him, moreover, the co-accused Binod Yadav against whom there was an allegation of firing, has been granted privilege of anticipatory bail by co-ordinate Bench of this Court vide Cri. Misc. No. 6721 of 2015.

Learned counsel further submits that the petitioner

Patna High Court Cr.Misc. No.31748 of 2017 (2) dt.13-07-2017 2/2 has got no criminal antecedent and the parties have in fact entered into a compromise.

In the facts and circumstances of the case, let the petitioner namely Bhushan Yadav, in the event of his arrest/surrender before the court below within four weeks, from today, be enlarged on bail on furnishing bail bond in the sum of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Danapur Patna, in connection with Paliganj P.S. Case No. 134 of 2013, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. The petitioner shall immediately join investigation and shall report to the Investigating Officer within a week and thereafter as and when required to conclude the investigation at the earliest.
