JUSTICE PURNENDU SINGH ORAL ORDER 14-08-2025 Heard Mr. Gagandeo Yadav, learned counsel appearing on behalf of the petitioner; Mr. Bhola Prasad, learned counsel for the opposite party no. 2 and Mr. Tarun Prasad Mandal, learned A.P.P. for the State.

2. The petitioner seeks pre-arrest bail in connection with Laukahi P.S. Case No. 250 of 2023, registered for the offence punishable under Sections 376, 420, 366(A) of the Indian Penal Code and Sections 4 and 6 of the POCSO Act.

3. Considering the nature of allegation made in the FIR against the petitioner, I am not inclined to enlarge the petitioner on pre-arrest bail.

4. However, the petitioner, if so advised, may surrender before the learned District Court and seek regular bail. In that case, learned District Court is directed to consider the regular bail application of the petitioner on the same day and pass necessary order in accordance with law considering the fact that trial has not been concluded yet as per the mandatory time contained in Section 35 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.

5. Accordingly, the present bail application stands disposed of.
