JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 23-07-2018 Learned counsel for the petitioner is permitted to add Bihar Animal Science University as party respondent no.4. Heard learned counsel for the petitioner and the counsel appearing on behalf of the Bihar Agriculture as well as on behalf of the Animal Science University and the counsel for the State.

Learned counsel for the petitioner has placed reliance of the order passed by the co-ordinate Bench of this Court whereby the writ court disposed of the writ application with a direction to the University to consider the case of the petitioner in the light of the judgment of the Apex Court in the case of Secretary, State of Karnataka and Ors. Vs. Umadevi

Patna High Court CWJC No.15567 of 2012 dt.23-07-2018 2/2 and Ors. reported in (2006)4 SCC1, subsequent to the judgment of State of Karnataka and Ors. Vs. M.L. Kesari and Ors. reported in (2010) 9 SCC 247 submitted that the present writ application may be disposed of similar line. In view of the above,the writ petition is disposed of. The University is expected to take fresh decision on the claim of the petitioner for regularization in the light of the judgment of the Apex Court in the case of Umadevi and Ors. Vs. M.L. Kesari and Ors. at the earliest preferably within a period of six months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
