2. Petitioner is in custody since 01.02.2025 in a case in connection with Bahoranpur P.S. Case No.18 of 2025 registered for an offence punishable under Sections 109(1), 352, 351(1) 3(5) of the B.N.S and Section 27 of the Arms Act.

3. As per the prosecution case, it is alleged that petitioner along with other co-accused persons started assaulting and abusing the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that the allegation against the petitioner is that he is the order giver and the specific allegation is against other co-accused person. He further submits that petitioner is aged about 69 years old as mentioned in the bail petition and he

Patna High Court CR. MISC. No.28563 of 2025(2) dt.07-05-2025 2/2 is under custody since 01.02.2025. He next submits that petitioner has got no criminal antecedent as stated in para-3 of the bail petition.

5. Learned APP for the State as well as learned counsel for the informant vehemently opposes the prayer for bail of the petitioner and submits that allegation against the petitioner is for instigation the other co-accused persons.

6. Considering the aforesaid facts and circumstances of the case, submission of the learned counsel for the petitioner as well as the fact that allegation against the petitioner is of being a order giver and the specific allegation is against other co-accused and also the fact that petitioner has got no criminal antecedent, let the above named petitioner be released on bail, on his furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Bahoranpur P.S. Case No.18 of 2025.
