JUSTICE PRABHAT KUMAR JHA ORAL ORDER 28-09-2020 Heard Ms. Smita, learned counsel for the petitioner and Mr. Akbar Ali, learned A.P.P. through Video Conferencing. Petitioner seeks bail in Neemchak Bathani P.S. Case No.83 of 2017 registered under Sections 147, 341, 323 and 307 of the IPC.
The informant alleged that on 22.06.2017 Ranjeet Kumar was getting the soil cut near the land of Rajdeo Yadav. The land of the informant is situated adjacent to that land. On account of cutting soil, there was narrowing of path. When the informant objected, Ranjeet Kumar (petitioner), Arun Kumar, Ravi Kumar, Kamlesh Yadav, Jitendra Yadav, Arjun Yadav, Shailendra Yadav, Mithilesh Yadav and Brahmdeo Yadav surrounded the informant and assaulted the informant, his brother Birendra Kumar and his two sons, namely, Rajneesh

Learned counsel for the petitioner submits that there is omnibus and general allegation against all the accused persons. Ajay Kumar (informant) got two injuries. Birendra Kumar also got injury. Rajneesh Kumar and Chandamani Devi also got injuries. Birendra Kumar and Ajay Kumar received grievous injuries but there is only omnibus and general allegation against the accused persons. It is submitted that there is a counter case filed by the wife of the petitioner. The petitioner is in jail since 01.05.2020. The petitioner has already remained in jail for about five months.
Taking into consideration the facts that there is a case and counter case and there is omnibus and general allegation against the accused persons and the fact that the petitioner has already remained in jail for about five months, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M. Xth, Gaya in connection with Neemchak Bathani P.S. Case No.83 of 2017.
