Mr. Nagendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-04-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. Total 200 liters of country-made liquor has been recovered from bush and three motorcycles were seized on spot.

4. Learned counsel for the petitioners submits that petitioners are neither owner nor driver of any of the seized motorcycles and have been implicated in this case only on suspicion. No incriminating article has been recovered from the conscious possession of these petitioners.

5. Learned A.P.P. for the State has opposed the bail

Patna High Court CR. MISC. No.24082 of 2025(2) dt.30-04-2025 2/2 petition and submitted that in this case, huge quantity of illicit liquor has been recovered. Though, petitioner no. 1 claims clean antecedent, but petitioner no. 2 has one criminal antecedent of similar nature and petitioner no. 3 has got six criminal antecedent of similar nature.

6. Considering the six criminal antecedent of similar nature, the prayer for anticipatory bail of petitioner no. 3 is rejected.

7. Since petitioner no. 1 has got clean antecedent and petitioner no. 2 is accused in one case of similar nature, in the event of their arrest/surrender within a period of eight weeks from today, they are directed to be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. - 02, Aurangabad, Bihar in connection with Obra P.S. Case No. 116 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
