2. In the present case, the petitioner is apprehending his arrest in connection with Barachatti (Mohanpur) P.S. Case No. 910 of 2023 for the offences under Sections 379 and 411 of the Indian Penal Code and Section 11 of the Prevention of Animal Cruelty Act.

3. As per prosecution case, on the basis of secret information, a pick-up vehicle was intercepted, which was carrying four oxen, one cow and one calf, without any papers. The petitioner is stated to be the owner of the said pick-up van. The co-accused cleaner was apprehended and the co-accused driver fled away from the spot.

4. The learned counsel for the petitioner submits that

From the FIR, it is clear that there is no allegation that the cattle loaded on the vehicle were stolen property and there was involvement of this petitioner. The petitioner has no concern with the said occurrence and other co-accused persons and has been made accused in this case merely on the ground that he is the owner of the said vehicle. The petitioner is having clean antecedent.

5. The learned A.P.P. vehemently opposes the submission made on behalf of the petitioner.

6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the completely vague nature of allegation and strong possibility of false accusation, let the petitioner above named in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Sherghati, Gaya, in connection with Barachatti (Mohanpur) P.S. Case No. 910 of 2023, subject to the condition laid down under Section 438(2) of the code of Criminal Procedure and other
