JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 06-10-2016 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State. The petitioners apprehend arrest in relation to a case registered for the offence punishable under sections 341, 323, 504, 379, 307/34 of the Indian Penal Code. Later on Section 302 of the Indian Penal Code was added after the death of the injured after about seven days of the occurrence. Learned counsel for the petitioners draws the attention of the Court to the fact that there is case and counter case and both the cases are amongst Gotias (agnates). All are family

Be that as it may, the petitioners above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Nimchak Bathani P.S. Case No. 63 of 2016 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
