JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 307, 323, 448 and 498A/34 of the Indian Penal Code.

The basic accusation is of torture and causing severe burn injuries.

It is submitted by learned counsel for the petitioner that during hearing of anticipatory bail application of the husband of the informant, Devendra Sharam, the informant appeared before this Court and accepted the offer of the husband to reside together and on that basis, the husband of the informant has been granted provisional anticipatory bail for six months. Considering the same, let the above named petitioner

Patna High Court Cr.Misc. No.57854 of 2015 (2) dt.08-01-2016 2/2 be released on provisional anticipatory bail for nine months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 121 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner will be confirmed by learned court below if the matrimonial harmony is substantially restored between the informant and her husband then the provisional bail of the petitioner will be confirmed otherwise the petitioner will surrender and pray for regular bail.
