2. The present writ petition has been filed by the petitioner for issuance of an appropriate writ/writs, order/orders, direction/directions to the respondents, particularly a writ of certiorari for quashing of letter bearing No. BEP/SSA/ MGT-

Patna High Court CWJC No.7235 of 2026 dt.12-05-2026 2/3 168/2018-19/813 dated 29.03.2023 issued under the signature of District Programme Officer, Primary Education and Sarva Siksha Aviyan Katihar by which the petitioner was discharged from the work as Executive Assistant and further for a direction to the respondents to allow the petitioner to work as Executive Assistant holding his service in continuation with all financial and consequential benefits and further for any other appropriate relief/relives for which the petitioner is entitled in the facts and circumstances of the case.

Learned Counsel for the petitioner submits that Annexure-1 is the order contained in Memo No. 1450 dated 11.10.2018 issued by the District Establishment Deputy Collector, Katihar, by virtue of which petitioner has been engaged for one year. He submits that his engagement was extended time to time but all of a sudden by virtue of letter No. 813 dated 29.03.2023 issued by which he has been directed to stop the work. In this regard, petitioner filed an application before the District Programme Officer, Primary Education and Sarva Siksha Aviyan, Katihar, but no decision has been taken by the District Programme Officer, Primary Education and Sarva Siksha Aviyan, Katihar. Counsel submits that he has repeatedly file application before the District Magistrate, Katihar, but they

Counsel for respondent No. 8, the District Programme Officer, Primary Education and Sarva Siksha Aviyan, Katihar, submits that the service of the petitioner was initially for one year and time to time extended and by virtue of impugned order his service was reverted back.

4. It transpires to this Court that the appointing authority of the petitioner is the Deputy Collector Establishment, District- Katihar.

5. In this view of the matter, this writ petition is disposed off directing the petitioner to file his detailed representation along with a copy of this order within 30 days from today before the Deputy Collector Establishment, Katihar (Respondent No. 5) raising all his grievances and Respondent No. 5, the Deputy Collector Establishment, Katihar shall pass a reasoned and speaking order in accordance with law within 90 days from the date of receipt/production of a copy of this order.
