The petitioner seeks bail in a case instituted for the offences under Sections 324, 307, 504, 506 of the Indian Penal Code in which section 302/34 IPC was added later on.. The prosecution case in short is that the accused persons caused death of the informant by pouring petrol on him and set him on fire due to which sustained burn injury and later succumbed to the injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.5.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been

There is no substantive evidence to suggest his implication in the present case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R. There is specific allegation against the petitioner for pouring petrol upon the deceased and setting him on fire. The petitioner is alleged to be assailant. Considering the same, I am not inclined to grant bail to the petitioner in connection with Kankarbagh P.S. Case No. 601 of 2016 (Sessions Trial No. 52/2019). The same is rejected. The Trial Court is directed to conclude the trial at the earliest preferably within nine months from the date of receipt/production of a copy of this order.
