JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 This is an application for grant of anticipatory bail in connection with S. C. Trial No. 1344 of 2018 arising out of Complaint Case No. 1048C of 2017, disclosing offences under Section 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

Prosecution case is that petitioner demanded dowry and also trying to kill her but she saved due to intervention of the neighbours.

Submission of the learned counsel for the petitioner is that he is still ready to keep her with full dignity and care. He has falsely been implicated in this case.

Heard learned A.P.P. also.

Patna High Court CR. MISC. No.26928 of 2019(4) dt.17-07-2019 2/2 Earlier notice was issued to the opposite party no.2, which has been received by her, but nobody appears on her behalf nor any Vakalatnama has been filed on behalf of opposite party no.2.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, West Champaran at Bettiah, in connection with S. C. Trial No. 1344 of 2018 arising out of Complaint Case No. 1048C of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
